CANCELLATION & REFUND POLICY

This document outlines the cancellation and refund conditions related to sales made through www.flexamus.com by Flexamus® INNOIT (hereinafter referred to as “Flexamus® INNOIT”). Buyers are subject to the regulations of the European Union's Consumer Rights Directive and the General Data Protection Regulation (GDPR), as well as other applicable laws.

Products and services purchased through www.flexamus.com may be canceled or refunded according to the terms specified in this policy, depending on their type. The terms and conditions for cancellations and refunds are outlined in the following sections.

For the purposes of this refund policy, the agreement date refers to the purchase date of a product or service processed under a valid product or service agreement by Flexamus® INNOIT.

Cancellation/Refund and Right of Withdrawal for Software Products:

According to the Consumer Rights Directive, for contracts related to services performed instantly in electronic environments or intangible goods delivered to consumers immediately, the Customer cannot exercise the right of cancellation, refund, or withdrawal after purchasing the software product. Cancellation or refund requests are only accepted if there is an irreparable defect in the software. Situations where the software lacks certain features or where expert configurations are required but cannot be performed due to insufficient knowledge or experience are not considered defects. The Customer is responsible for reviewing the software and requesting necessary information before purchase. The Customer agrees and undertakes these conditions.

License Change for Software Products:

Software products are licensed to the domain name (URL) specified by the Customer at the time of purchase. The Customer may request a one-time free license domain name change. However, once this change is made, no further changes can be requested. The Customer agrees and undertakes these terms.

License Transfer/Assignment for Software Products:

The Customer has the right to transfer or assign their software license to another Flexamus® INNOIT customer. After the transfer, the new customer will also have the right to change the license domain name once.

Leased Software Products:

For software products leased on a monthly or longer-term basis, license information changes, transfers, or assignments are not allowed. The Customer agrees and undertakes these conditions.

Non-Cancellable and Non-Refundable Products and Services:

Unless Flexamus® INNOIT provides a solution for an issue or grievance, the following products and services are non-cancellable, non-refundable, and cannot be exchanged:

  • Domain names (registration and renewal)
  • Third-party licenses
  • SSL and security products
  • Server services (subject to special refund conditions)
  • E-Commerce Websites
  • Web design services
  • Support and design fees
  • Additional disk and traffic charges for hosting

Additional Terms and Conditions:

1. Product Delivery:

Product or service delivery will be completed after the payment process is verified. Delivery details and timelines will be communicated electronically to the customer during the order process.

2. Technical Support:

Flexamus® INNOIT will make reasonable efforts to provide technical support for the operation of products or services. Technical support is available only through Flexamus® INNOIT's designated communication channels and during working hours. The scope and duration of technical support depend on the type of product or service.

3. Subscriptions:

For recurring subscription services, cancellation must be requested at least 7 days before the renewal date. If cancellation is not timely communicated, the subscription will be automatically renewed, and fees paid will not be refunded.

4. Custom Projects:

Cancellation and refund requests are not accepted for software, design, or services developed specifically for the customer. Custom projects are tailored to the customer's requests and are therefore excluded from the refund policy.

5. Contract Term and Renewal:

All services are subject to a specified contract term. For services requiring renewal, Flexamus® INNOIT will notify the customer before the renewal process and request the renewal fee. If payment is not made, the service may be automatically suspended or canceled.

6. Review of Cancellation and Refund Requests:

Cancellation and refund requests will be reviewed by the Flexamus® INNOIT customer service team. All requests will be finalized within 14 business days. The final decision on cancellation or refund requests will be made by Flexamus® INNOIT, taking into account all relevant documents and evidence.

Refunds

The Customer can receive refunds through the original payment method or request the amount to be credited as a balance in their account. Alternatively, refunds can be issued as credit to the customer's account based on their request.
