A- GENERAL SERVICE AGREEMENT

THIS AGREEMENT IS VALID FOR SERVICES PROVIDED OVER THE INTERNET AND CONSISTS OF RULES THAT DEFINE THE TERMS OF USE OF HOSTING SERVICES BETWEEN Flexamus® INNOIT AND NATURAL PERSONS OR LEGAL ENTITIES. BEFORE ORDERING ANY PRODUCT FROM OUR WEBSITE, YOU MUST READ THE SERVICE AGREEMENT AND THE TERMS OF USE, WHICH ARE AN INTEGRAL PART OF THIS AGREEMENT, IN FULL. THE SERVICE AGREEMENT INCLUDES THE RULES YOU MUST FOLLOW. IF YOU DO NOT ACCEPT THIS AGREEMENT OR ANY OF ITS TERMS, PLEASE CANCEL YOUR ORDER PROCESS AND REFRAIN FROM ORDERING ANY PRODUCT OR SERVICE.

1. SERVICE PROVIDER AND PARTIES

This agreement is concluded between Flexamus® INNOIT (hereinafter referred to as "Flexamus® INNOIT") and customers who purchase services provided by Flexamus® INNOIT (hereinafter referred to as the "CUSTOMER").

2. SUBJECT OF THE AGREEMENT

The subject of this agreement is to define the mutual rights and obligations of the parties concerning the purchase/sale of the services and products specified below, ordered electronically by the CUSTOMER via the internet site of Flexamus® INNOIT, in accordance with the provisions of the EU Directive on Distance Contracts and other applicable legal regulations. By approving the agreement, the CUSTOMER is deemed to have accepted the provisions of this agreement and updates made by Flexamus® INNOIT from time to time.

3. TERM OF THE AGREEMENT

This agreement becomes effective on the date the CUSTOMER pays for the ordered service and remains in force throughout the service commitment period. If no commitment period is specified, the agreement is valid for one payment period and continues until the next payment is made.

4. INFORMATION SECURITY AND QUALITY MANAGEMENT

Flexamus® INNOIT is committed to protecting customer information and improving service quality by implementing TS ISO IEC 27001:2013 Information Security Management Systems, TS EN ISO 9001:2015 Quality Management Systems, and other relevant standards. The TS ISO IEC 27001:2013 Information Security Management System, in particular, has been established, implemented, operated, and continually improved within Flexamus® INNOIT.

5. PRODUCTS SUBJECT TO THE AGREEMENT

The CUSTOMER acknowledges being informed about the specifications of the servers, dedicated servers, virtual servers, hosting, and other services ordered for use in the data center of Flexamus® INNOIT. By confirming this information electronically, the CUSTOMER declares awareness of the product and all relevant information. Furthermore, the CUSTOMER acknowledges receiving prior information and being informed about the right of withdrawal related to the delivery of the service.

6. SERVICE DELIVERY, PERFORMANCE LOCATION, AND METHOD

The ordered service is hosted on servers allocated to the CUSTOMER in the Flexamus® INNOIT data center, and all service-related information is sent to the CUSTOMER’s registered email address. The CUSTOMER is responsible for maintaining the security and confidentiality of the access information for the service.

7. CUSTOMER RESPONSIBILITIES

The CUSTOMER is responsible for securely storing and using the passwords and information required to access the service. The CUSTOMER agrees to use the services provided by Flexamus® INNOIT in compliance with the law and refrains from publishing unlawful content. Additionally, the CUSTOMER accepts liability for any damages arising from misuse of the servers provided by Flexamus® INNOIT.

8. FEES, PAYMENTS, AND REFUNDS

Payments for services must be made upfront by the CUSTOMER and repeated regularly according to the service duration. Cancellation and refund requests are evaluated in accordance with the refund policies of Flexamus® INNOIT. Refunds are not available for third-party products such as domain names or SSL certificates.

9. TAXATION

All transactions related to the services offered by Flexamus® INNOIT are carried out in compliance with Belgian and EU tax legislation. Any changes in tax laws will be reflected in this agreement and deemed accepted by the parties.

10. COMPETENT COURTS AND ENFORCEMENT OFFICES

In the event of any disputes arising from the implementation of this agreement, the competent courts and enforcement offices of Brussels, Belgium, shall have jurisdiction.
